Reasonable H-1B Processing Times: How Long Is Too Long?

If it harms American workers in any way, any time is not long enough according to Title 8 of US law.

“The Administrative Procedure Act prohibits agencies from unlawfully delaying decisions. A petitioner can sue the agency in federal court, asking for an order to make a decision”.


But Title 8 bars ALL foreign workers for any reason, even if they are more skilled, if admitting them to the US for work harms an American in any way.

Which means according to Title 8 foreign workers can’t sue the US gov’t over any work-related issues if they are Inadmissible Aliens to begin with.
